After a month of researching legalities of CBD industry here in Colorado, I must say I’m still confused. I went to city authorities and at one point was told I needed a $50,000 permit, ya no! So went to the state level with Dept of Ag, my intent was to make cbd infused dog treats with proper dosage. NOPE can’t do that it’s illegal, so I said I’m going to keep calling until you say yes to something. Decided I would make cbd infused creams etc. I was told yes it was legal but don’t ship across state lines. Hmmm ok. Do you have to be 21 to purchase? No! Well needless to say I made product, set up website and carried on, I’m two weeks into it and SQuare credit card has cut me off! I’m am totally confused as to what I can and can’t do as I tried to follow all the laws etc. I would so appreciate any input you have on this!
CBD is a compound found in the hemp plant, also known as Cannabis Sativa L. CBD products that are available on the market, such as Green Roads products, are made from industrial hemp. The main difference between hemp and industrial hemp is that the latter has Non-Detectable THC. THC, or tetrahydrocannabinol, is a psychotropic chemical found in cannabis. The CBD products available to all customers in the U.S. contain very small amounts of THC.

Hemp producers who sell CBD products will often use the 2014 Farm Bill to claim that it is legal. This bill includes a provision that allows for the legal cultivation of hemp provided it is used for academic agricultural research or under a state pilot program. But there is still confusion about whether the legal allowance for cultivation also includes selling it.
Unlike THC, CBD will not make you high. That said, this doesn’t mean CBD is not at all psychoactive, as many assert, says Jahan Marcu, PhD, director of experimental pharmacology and behavior at the International Research Center on Cannabis and Mental Health in New York City: “CBD does change cognition. It affects mood, which is why people take it for anxiety. And some find that it makes them more alert.”
As of May 2017, however, you will find the addition of "Marihuana Extract" in the Texas Register [PDF] (not the Health and Safety Code) by the order [PDF] of the Commissioner of the Department of State Health Services. That order is what the Tarrant County District Attorney is using as a basis to prosecute CBD oil possession cases at the misdemeanor level.

As far as recreational marijuana goes, many bills are on the table in other states, however, it remains illegal for recreational use in: New York, New Jersey, Kentucky, Missouri, Utah, Florida, North Carolina, South Carolina, Idaho, Indiana, Alabama, Wyoming, Maryland, Minnesota, New Mexico, South Dakota, Tennessee, West Virginia, Montana, Connecticut, Rhode Island, North Dakota, Hawaii and New Hampshire.

There are a number of possible side effects to using CBD oil, such as fatigue, dry mouth, lightheadedness, hypotension, and impaired motor functions. However, when used in moderate amounts, most people do not experience these side effects, and none of them are known for being fatal or particularly dangerous. Hemp seed oil has been pressed from hemp seed, and it’s great for a lot of things — it’s good for you, tastes great, and can be used in soap, paint — even as biodiesel fuel.

In your internet travels, you may also come across products called “terpsolates.” The manufacturers of these products infuse CBD Isolate with terpenes (but not cannabinoids like THC). These terpenes may enhance the effectiveness of CBD — or maybe they just make it smell good. This may be a good place to point out that not all CBD products are created equal. The industry is still largely unregulated, and the quality and quantity of CBD in a given product will vary wildly. Third-party testing definitely helps to monitor companies’ claims, but it’s still up to you as the consumer to do your homework on the best CBD products.

Honestly, I began to wonder if I was just experiencing the placebo effect. But on the one day, I didn’t take my CBD oil, I ended up picking a fight with my boyfriend (totally my fault) and let a few off-color remarks by a family member mess with my mood. There is a strong sedative quality to CBD hemp oil, making it a popular remedy for people with insomnia, sleeplessness, interrupted sleep, post-traumatic stress disorder, restless leg disorder, and other night-time issues. In the United States, CBD itself is not specifically listed in the United States Controlled Substances Act like the psychoactive compound, tetrahydrocannabinol (THC). The US government, which specifies which parts of cannabis plants are prohibited, excludes hemp’s “mature stalks” and “oil or cake made from the seeds” and “sterilized seeds” from its definition of “marihuana.”
Whether you will be prosecuted for possession of CBD oil in Texas depends entirely upon where you are located.  In North Texas, Denton County is not prosecuting CBD oil only cases, Dallas County is "not aggressively prosecuting" CBD oil cases, and the Collin County District Attorney is still deciding. Tarrant County, on the other hand, is prosecuting CBD Oil cases.
The Texas Controlled Substances Act is codified under Texas Health and Safety Code Chapter 481. Health and Safety Code Section 481.032 says that the Commissioner of State Health Services is to set out what substances are deemed Controlled Substances in Texas under Schedules I through V. Chapter 481.034 retains the right for the legislature to remove substances from the Controlled Substance list.
House Bill 2107 was brought during the 2017 legislative session with a number of vocal supporters. The bill sought to remove the “low THC” restriction and amend the law to allow for “medicinal marijuana.” It also sought to expand the types of conditions that can be treated with cannabis by including post-traumatic stress disorder and terminal cancer. Finally, the bill sought to modify the language, from requiring a doctor’s prescription to requiring a doctor’s recommendation. This change intended to address concerns about the legality of physicians prescribing something prohibited by federal law. Despite having 77 sponsors and co-sponsors, 29 of whom were Republican, the bill died in committee. Given strong support, as well as national trends, changes in Texas law are likely to occur in the future.
President Obama’s execution of the Agricultural Act of 2014 is an integral piece to CBD oil’s legality. If a plant is deemed legal (where the determining factor is a THC level under .3%) that then makes all products made from the source material legal as well. Both methods produce a CBD oil byproduct that is then combined with a fluid like MCT oil, coconut oil, or olive oil so that it can be delivered to the body. Always check to make sure you know the CBD content of the products you purchase.

Despite the many states that have legalized some or all forms of marijuana, federally the U.S. Drug Enforcement Administration (DEA) continues to classify CBD as a Schedule I drug. Schedule I drugs are defined by the DEA as "drugs with no currently accepted medical use and a high potential for abuse." This is how not just CBD, but the entire cannabis plant is classified.
So. According to the Controlled Substance Act definition itself, certain parts of the cannabis plant are clearly illegal, while others fall into a grayer area. One of these – for the most part – is CBD extracted from the “legal” parts of the cannabis plant, and non-marijuana industrial hemp plants, which, as defined by Section 7606 of the Farm Bill are cannabis plants with less than 0.3 percent THC.
