That’s because CBD comes from cannabis and, like nearly all other parts of the plant, is categorized by the Drug Enforcement Agency (DEA) as a Schedule 1 drug—the most restrictive classification. (Others on that list: heroin, Ecstasy, and peyote.) This classification, which cannabis advocates have tried for years to change, keeps cannabis-derived products, including CBD, from being properly studied in the U.S.
While hemp-derived CBD sourced from marijuana plants still remains subject to individual state laws, when sourced from hemp products, CBD can be purchased and consumed in all 50 states as long as it is grown in accordance with the Act. This means that CBD’s legal status on a federal level is quite clear, however, on a state level there’s some variation.
CBD is the major non-euphorigenic component of Cannabis sativa. Some research is beginning to show that CBD is different than other well-studied cannabinoids. All cannabinoids function as ligands, meaning they dock onto the binding site of a protein and have the ability to modulate a receptor’s behavior. CB1 receptors are widely distributed, but are particularly abundant in areas of the brain, including those concerned with movement, coordination, sensory perception, emotion, memory, cognition, autonomic and endocrine functions.

In Georgia, for example, the legislature passed a law in 2015 that made legal possession of up to 20 ounces of CBD for patients with qualifying conditions like seizure disorders and multiple sclerosis. The law does not, however, set up any supply infrastructure—there are no licensed dispensaries or producers. Recently, the Georgia legislature passed a compromise law that includes Alzheimer’s disease, AIDS, autism, epidermolysis bullosa, peripheral neuropathy, and Tourette’s syndrome in the list of diseases that can be treated by CBD—as long as that CBD oil has no more than 5 percent THC.
In 2015, Governor Greg Abbott signed into law what’s known as the Texas Compassionate Use Act, which allows the use of CBD oils to treat seizures caused by intractable epilepsy. The Act legalizes oils containing CBD for treatment of epilepsy, as well as other chronic medical conditions for those who have not responded positively to use of federally approved medications.
Cannabis oil and CBD have similarities but some important differences for users. Both are cannabinoids that can be found in all cannabis plants including hemp and marijuana. Cannabinoids are the substances secreted by the flowers of the cannabis plant and contain natural medicinal properties, offering relief from conditions including anxiety, pain, nausea, and inflammation.
In practice, selling CBD seems to be legally riskier than possessing it. The DEA’s priority seems mostly to concern commercial violations; most cases involved smoke shops and non-cannabis vape stores selling CBD cartridges. In 2015, police seized CBD cartridges at a vape store near Milwaukee, but the store owners were never arrested or charged. (A 2014 law made it legal for patients to possess and use CBD oil in Wisconsin, but the law did not make it legal to sell.) That same year, police in central Florida arrested the owner of a local smoke shop chain for selling CBD products.
CO2 extraction is one of the most common ways CBD is extracted from the hemp or cannabis plants. This method uses expensive equipment that adjusts temperature and pressure to extract the cannabinoids from the plant material, without damaging them. The other common method is to use solvents like ethanol or butane to extract the plant material. These solvents have to be burned off the final product which may damage the cannabinoids or terpenes in the process. There is also a risk that these solvents may not have burned off completely and could end up in your end product.
